23 December 2011 -The Philippine Embassy in Warsaw reported to the Department of Foreign Affairs that together with the Embassy, the National Labor Inspectorate of Poland conducted for the first time a seminar on the legal work of foreigners in Poland for overseas Filipino workers (OFWs) in the country at the conference room of the Embassy on December 17.
Chief Specialist Jarosław Cichoń and Specialist Darius Gorski of the Legality of Employment Department of the Chief Labor Inspectorate explained to and discussed with the OFWs the requirements for legal work and the consequences of illegal work, the requirements when changing employers, the conditions when changing work in a position different from the work permit and the main provisions of an employment contract.
Close to 40 OFWs who participated in the seminar were able to consult with the Labor Inspectorate representatives on their specific cases, such as the possession of their employment documents, appropriate contracts and documents, average working hours, and salaries.
The representatives advised the OFWs to seek the help of the appropriate district labor representative should they have any contract provisions violated by their employers. The filing of complaints in the labor courts is free of charge for claims below PLN50,000 (estimated at US$15,151).
Chief Specialist Cichoń also touched on the issue of trafficking in persons and assured that district labor inspectors are trained to detect cases of trafficking. If victims of trafficking, the OFWs were advised to seek the help of the National Intervention and Consultation Center for Victims of Human Trafficking run by the La Strada Foundation.
In closing, the Labor Inspectorate representatives, in explaining the basic employee rights, stressed that foreigners employed in Poland enjoy the same protection by the law as Polish citizens. Thus, OFWs cannot be discriminated against due to their nationality, citizenship, ethnic origin, race or religion.
