Where can I submit an application for issuing Work Permit?

A permit is issued by the Voivode competent for the seat / place of residence of the employer.

The employer applies for a work permit for a foreigner.

Documents attached to the application should be submitted in the original or officially certified for compliance with the originals (with the exception of the identity card and passport).

Documents in a foreign language should be translated into Polish by a sworn translator.

Which documents do I have to submit?

Please familiarize yourself with the descriptions of different Work Permits given below and choose the appropriate type of Permit

Work Permit A - concerns foreigners working on the territory of the Republic of Poland, basing on an agreement with an entity whose seat or place of residence, branch, facility or other kind of organized activity is located on the territory of the Republic of Poland.

Work Permit B – concerns foreigners performing a work of holding a position in the management of a legal person entered into the register of entrepreneurs or being a corporation in the process of formation for 6 months during the following 12 months

Work Permit C – concerns foreigners performing work for foreign employer, who are seconded employees, delegated to work on the territory of the Republic of Poland for a period of time no longer than 30 days in calendar year to department or facility belonging to foreign or affiliated entity, as provided for the Act of 26 July 1991 on personal income tax, with a foreign employee

Work Permit D – concerns foreigners, who perform work for foreign employer having no branch, facility or other kind of organized activity on the territory of the Republic of Poland and are seconded employees, delegated to work on the territory of the Republic of Poland in order to provide temporary and occasional service (export service)

Work Permit E – concerns foreigners, who perform work for foreign employer and are seconded employees, delegated to work on the territory of the Republic of Poland for a period of time longer that 30 days during the following 6 months in order different than specified in B, C and D permits.



Which fees do I have to pay?

The appropriate one of the below payments should be attached to the application for issuing the Work Permit:
  • 50 PLN - in case of providing the foreigner with work for a period of time no longer than 3 months;
  • 100 PLN - in case of providing the foreigner with work for a period of time no longer than 3 months;
  • 200 PLN – in case of providing the foreigner with work, who has been delegated to work on the territory of the Republic of Poland in order to provide an export service (applicable to Work Permit D).
In case of submitting the application for extending the Work Permit, the amount payment shall be equal to half of the amount of specified above.
Proof of the payment should include the following data:
  • name of the entity, which makes the payment (full legal name / first name and surname, as well as the employer’s seat / place of residence)
  • deposit title/description of the aim of the payment (issuing a permit or extending of Work Permit with specification of full name and surname of the foreigner, for whom the application for issuing a Work Permit is requested)





How long will I wait for a decision?

The decision on Work Permit is issued not later than within a month, and when the case is highly complicated – not later than within two months after the day of proceedings initiation.

According to Art. 35 § 5 of the Administrative Procedure Code, terms envisioned by the provisions of law to perform specified action, periods of suspension of proceeding and periods of delays caused by party’s fault or causes independent of legal institution are not included.



Appeal procedure

If you are not satisfied with the decision rendered, you can make an appeal.

The appeal is submitted to the Minister of Labour and Social Policy through the Voivodship Governor within 14 days from the date of delivery of the decision.

The appeal from the decision of the Mazowieckie Governor on Work Permit for the foreigner has to be submitted in paper form.
